Copying
Definition:
To constitute an infringement of copyright, a work must be a "copy" in the sense that it is substantially similar to a copyrighted work, it must have been "copied" from the copyrighted work as opposed to being the result of coincidental, independent production.
Goodwill
Definition:
The value of a business or of a line of goods or services, beyond its tangible assets, that reflects its commercial reputation.
Arbitrary Marks
Definition:
Comprise words that are in common linguistic use but, when used to identify particular goods or services, do not suggest or describe a significant ingredient, quality or characteristic of the goods or services.
